SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
We reserve the right to refuse, cancel, or block any order that we suspect to be fraudulent, misleading, or in violation of our Terms of Service. This includes, but is not limited to, orders placed using false or incomplete information, unauthorized transactions, or those made with stolen payment details. Orders associated with unusual purchasing patterns, such as bulk purchases by unauthorized resellers, may be limited or prohibited at our discretion. If such a change or cancellation occurs, we may attempt to notify the customer via the email address, phone number, or billing address provided at the time of purchase.
Orders found to be linked with fraudulent activity, such as stolen payment information, false billing addresses, or manipulated shipping details, will be subject to immediate cancellation. In such cases, we reserve the right to report the incident to relevant authorities, including the Reserve Bank of India (RBI), Cyber Crime Police, and payment networks such as Visa, Mastercard, UPI, and other financial institutions to prevent further misuse. Customers are responsible for providing and maintaining accurate, complete, and up-to-date billing and shipping information to facilitate smooth transactions and avoid order cancellations.
Additionally, users engaging in "Friendly Fraud", such as unauthorized chargebacks, false refund claims, or deceptive payment disputes, may face permanent account suspension. Such cases will be treated as fraudulent transactions and may result in legal action under Section 66D of the Information Technology Act, 2000 (Cheating by Personation using a Computer) and Section 420 of the Indian Penal Code (Cheating and Dishonest Misappropriation).
Customers acknowledge that in cases of suspected fraud, SolDelights reserves the right to request additional verification documents before processing an order. Failure to comply with such verification requests may result in order cancellation or account suspension.

Users may not engage in Click Fraud, Fake Traffic Generation, or Affiliate Fraud, including any attempt to manipulate advertising impressions, clicks, or commission-based revenues. Similarly, unauthorized price scraping, data mining, or web crawling of our website is strictly prohibited under Section 43 of the Information Technology Act, 2000, which addresses unauthorized access and data breaches. Any attempts to reverse-engineer, modify, tamper with, or bypass our website’s code, payment systems, or security infrastructure will be treated as a violation of cybersecurity laws in India and may lead to criminal prosecution.
Users are further prohibited from using our platform to spread hate speech, misinformation, defamatory content, or content that incites violence or promotes illegal activities. In no case shall Soldelights, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Limitation of Liability
Under no circumstances shall SolDelights, its directors, employees, or partners be liable for any direct, indirect, punitive, incidental, or consequential damages arising from the use of our website or services. Force Majeure Clause
SolDelights shall not be responsible for any delays, failures, or disruptions in service due to events beyond our reasonable control. This includes but is not limited to natural disasters, pandemics, cyberattacks, data center failures, third-party service disruptions, government regulations, or supply chain interruptions. In such cases, we shall not be held liable for any losses incurred, and service restoration will be conducted as per operational feasibility.
Additionally, SolDelights does not assume liability for any financial transactions, payment processing errors, or delays caused by third-party payment gateways, financial institutions, or regulatory interferences. Any disputes related to payments must be resolved directly with the respective payment provider in compliance with Reserve Bank of India (RBI) guidelines and the Payment and Settlement Systems Act, 2007.
This limitation of liability extends to any interactions with third-party services, integrations, or links provided on our platform. SolDelights is not responsible for any transactions, losses, or damages resulting from users engaging with third-party websites or external services accessed through our platform.
SolDelights shall not be liable for any unauthorized use of customer accounts, including but not limited to fraudulent transactions made using stolen credentials, provided such unauthorized use was not a result of direct negligence or security lapses on our part.
By using our website, users acknowledge that SolDelights has no obligation to compensate or indemnify for losses arising from any business disruptions, cyber incidents, technical malfunctions, external fraud, or any claims related to personal or commercial damages.
SECTION 14 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Soldelights and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service shall be governed by and interpreted in accordance with the laws of India, specifically under the provisions of the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Information Technology Act, 2000, and other applicable laws and regulations governing e-commerce, digital transactions, and cybersecurity.
Jurisdiction
Any disputes, claims, or legal proceedings arising from or related to these Terms shall be exclusively subject to the jurisdiction of the courts of Pune, Maharashtra, India. Users agree that any legal action brought against SolDelights shall be filed only in Pune, and SolDelights reserves the right to initiate legal proceedings in other jurisdictions where necessary to protect its rights and enforce legal claims.
Alternative Dispute Resolution (ADR) Clause
Before initiating formal legal action, both parties agree to first attempt to resolve any disputes through negotiation, arbitration, or mediation in accordance with the Arbitration and Conciliation Act, 1996. The arbitration process shall be conducted in Pune, Maharashtra, and the language of arbitration shall be English. The arbitration award shall be final and binding on both parties. If disputes cannot be resolved through ADR within a reasonable period, either party may proceed with legal action in a court of law within the jurisdiction of Pune.
Legal Costs & Indemnification
In the event of a dispute, the prevailing party shall be entitled to recover reasonable legal fees and costs incurred in enforcing these Terms. Users agree to indemnify and hold harmless SolDelights, its affiliates, directors, officers, employees, and agents from any legal claims, damages, liabilities, or expenses arising out of or related to violations of these Terms, misuse of services, or infringement of rights of third parties.
SECTION 18 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India.

SECTION 20 - FRAUD PREVENTION, CYBERSECURITY & LEGAL COMPLIANCE
SolDelights strictly prohibits any fraudulent, deceptive, abusive, illegal, or harmful activities on its platform. Users must not attempt to gain unauthorized access to user accounts, databases, systems, or networks through hacking, password cracking, or brute-force attacks, as such actions violate Section 43, 66, 66B, 66C, and 66D of the Information Technology (IT) Act, 2000. The use of automated programs, bots, scrapers, or similar tools to interact with our website is also forbidden. Deploying denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks, engaging in cyber intrusion, or any other form of digital sabotage is a criminal offense and may result in legal prosecution and immediate account termination.
Any form of fraudulent activity is strictly prohibited under IPC Section 420, IT Act Section 66D, and the Consumer Protection Act, 2019. Users must not create fake accounts, engage in identity theft, impersonate individuals or entities, or submit false or misleading information. The submission of fraudulent reviews, phishing attempts, unauthorized chargebacks, or deceptive financial transactions will be considered fraud and reported to relevant authorities. Any misrepresentation of SolDelights’ products, services, or branding for personal or financial gain is strictly forbidden and may result in permanent account suspension and legal consequences.
SolDelights does not tolerate cyber abuse, harassment, or the spread of malicious content under IPC Sections 354D, 499, and 500, and IT Act Sections 66A, 66E, 67, and 67A. Users must not engage in online harassment, stalking, or send unsolicited, defamatory, obscene, or pornographic messages via our platform. Posting offensive, misleading, or malicious content targeting SolDelights, its employees, or other users is strictly prohibited and may lead to criminal prosecution and financial penalties.
Furthermore, uploading, transmitting, or distributing malware such as viruses, spyware, trojans, keyloggers, or ransomware is a violation of IT Act Sections 43, 66, 67C, and 72A. Users must not engage in cyber sabotage or any activities that compromise the security and functionality of SolDelights’ digital infrastructure. Any unauthorized collection, sale, or distribution of personally identifiable information (PII) belonging to customers, employees, or third parties is strictly prohibited under IT Act Section 72A and the Personal Data Protection Bill, 2019. Attempts to de-anonymize or extract sensitive personal details from our systems without explicit consent will be treated as a serious legal violation and may result in prosecution.
SolDelights also strictly enforces protections against physical and intellectual property abuse under the Trademarks Act, 1999, IPC Sections 406 and 420, and the Copyright Act, 1957. Users must not engage in counterfeiting, duplication, or tampering with SolDelights’ products, packaging, branding, or labels. Unauthorized resale, alteration, or misuse of SolDelights’ intellectual property, including trademarks, logos, or product images, is a serious offense. Any attempt to falsely represent affiliation with SolDelights, create counterfeit products, or distribute misleading marketing materials may result in legal action and possible criminal charges.
To enforce these policies, SolDelights reserves the right to immediately suspend, terminate, or permanently ban users involved in any prohibited activities. Additionally, we may report cybercrimes, fraudulent activities, and data breaches to Indian Cybercrime Authorities (cybercrime.gov.in), the Ministry of Electronics & IT (MeitY), and other relevant government agencies. Users who violate these policies may face criminal prosecution under Indian laws, including the Information Technology Act, IPC, and the Consumer Protection Act. SolDelights also reserves the right to recover financial damages, legal costs, and compensation for losses resulting from fraudulent or malicious activities.
Users are strictly prohibited from engaging in credential stuffing, brute-force attacks, or attempting unauthorized access to other user accounts. Any such activity may, at its sole discretion and as deemed necessary report to CERT-In (Indian Computer Emergency Response Team) and relevant law enforcement authorities under IT Act, 2000
Users are responsible for maintaining the confidentiality of their account credentials and must report any suspected breaches immediately. If you identify any fraudulent, abusive, or harmful activity on our platform, you are required to report it to contact@soldelights.in without delay. SolDelights may, at its sole discretion and as deemed necessary, implement technical, legal, or operational measures to mitigate risks, investigate violations, and protect the integrity of its platform.
